ORDINANCE NUMBER 15-10796

 AN ORDINANCE PROVIDING FOR THE ANNEXATION OF A CERTAIN TRACT OF LAND IN SALINE COUNTY, KANSAS IN CONFORMITY WITH THE PROVISIONS OF K.S.A. 12-519 TO 12-526, INCLUSIVE.

 BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:

Section 1.  Findings. The following findings support the annexation of the property described in Section 2 by the City of Salina:
1. There is a utilities master plan that calls for extension of City utilities into this area.
2. Annexation is being requested by the property owner in order to have City utilities and services extended to their property.
3. The subject property is located in the City’s Urban Service Area and is contiguous to the existing city limits on the west.

Section 2.  Annexation. The following described tract of land:
A tract of land in the North Half of Section 6, Township 15 South, Range 2 West of the 6th P.M., and the Northeast Quarter of Section 1, Township 15 South, Range 3 West of the 6th P.M. all in Saline County, Kansas, and more particularly described as follows:

Commencing at the Northwest corner of said Section 6;
- Thence on an assumed bearing of North 89° 33’ 08” East on the north line of said Section 6, a distance of 65.00 feet;
- Thence South 00° 31’ 33” West, a distance of 157.03 feet to the corner of the tract described in the Saline County Register of Deeds Book: 388, page 994, and the Point of Beginning;
- Thence North 89° 32’ 12” East, a distance of 1224.35 feet to the corner of the tract described in the Saline County Register of Deeds Book: 388, page 994;
- Thence South 00° 26’ 36” East on the west line of the tract described in the Saline County Register of Deeds Book: 388, page 994, a distance of 630.91 feet to the north line of the tract described in Saline County Register of Deeds Book: 1013, page 253;
- Thence South 89° 23’ 52” West, a distance of 77.90 feet to the northwest corner of the tract described in Saline County Register of Deeds Book: 1013, page 253;
- Thence South 00° 46’ 12” East, a distance of 345.36 feet to the corner of the tract described in Saline County Register of Deeds Book: 1013, page 253;
- Thence North 89° 31’ 43” West on the north line and extensions thereof of the tract described in Saline County Register of Deeds Book: 1013, page 253, a distance of 1280.92 feet to the east line of Block 4, Corrected Plat of Liberty Addition No. 2, City of Salina, Saline County, Kansas;
- Thence North 00° 35’ 28” East on the east line of Block 4 and Block 3 of said Corrected Plat of Liberty Addition, a distance of 737.48 feet to the west line of the tract described in Saline County Register of Deeds Book: 384, page 213;
- Thence South 03° 15’ 18” East, a distance of 149.10 feet to the corner of the tract described in Saline County Register of Deeds Book: 384, page 213;
- Thence South 89° 23’ 12” East, a distance of 79.98 feet to the corner of the tract described in Saline County Register of Deeds Book: 384, page 213;
- Thence North 04° 28’ 45” East, a distance of 370.00 feet to the Point of Beginning.

Said Tract contains 28.46 acres more or less.

meeting one or more of the classifications for annexation prescribed by K.S.A. 12-519 to 12-526, inclusive, is hereby annexed and made a part of the City of Salina, Kansas. 

Section 3.  Repealer. That all prior ordinances in conflict herewith as they relate to the above described real estate are hereby repealed.

Section 4.  Summary of ordinance for publication. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.

Ordinance No. 15-10796 Summary

On March 28, 2016, the City of Salina, Kansas passed Ordinance No. 15-10796.  The ordinance annexes a 28.46 acre tract of land at the southeast corner of Schilling Road and South Ohio Street and the adjoining Ohio Street right of way to allow development of a new residential subdivision with City utilities and services.
