ORDINANCE NUMBER 16-10870
AN ORDINANCE PROVIDING FOR THE ANNEXATION OF A CERTAIN TRACT OF LAND IN SALINE COUNTY, KANSAS IN CONFORMITY WITH THE PROVISIONS OF K.S.A. 12-519 TO 12-526, INCLUSIVE.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. Findings. The following findings support the annexation of the property described in Section 2 by the City of Salina:
- The subject property is owned and maintained by the City of Salina, and is operated as a public natural area.
- Annexation is being requested by the property owner in order to establish city jurisdiction for emergency services and law enforcement on this public recreation area.
- The subject property is located within the City’s Urban Service Area and is contiguous with the existing city limits on the west.
Section 2. Annexation. The following described tract of land:
A tract of land in the West Half (W/2) of the Northeast Quarter (NE ¼) of Section 30, Township 14 South, Range 2 West of the 6th P.M., in Saline County, Kansas, and more particularly described as follows:
The portion of the West Half (W/2) of the Northeast Quarter (NE/4), Section Thirty (30), Township Fourteen (14) South, Range Two (2) West of the 6th P.M., in Saline County, Kansas, lying between the centers of the abandoned Smoky Hill River channels and the present River channel and the flood control levee. This tract, including 15 acres more or less, is bounded on the North by the abandoned river channel that flowed East, on the East by the present channel of the Smoky Hill River, on the South by the abandoned river channel that formerly flowed West, and on the West by the City of Salina flood protection levee.
Said Tract contains 15 acres more or less.
meeting one or more of the classifications for annexation prescribed by K.S.A. 12-519 to 12-526, inclusive, is hereby annexed and made a part of the City of Salina, Kansas.
Section 3. Zoning. All property described in Section 2 here of shall be classified as lying in an A-1 (Agricultural) zoning district upon annexation.
Section 4. Repealer. That all prior ordinances in conflict herewith as they relate to the above described real estate are hereby repealed.
Section 5. Summary of ordinance for publication. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
Ordinance No. 16-10870 Summary
On December 5, 2016, the City of Salina, Kansas passed Ordinance No. 16-10870. The ordinance annexes a 15 acre tract of land located between the flood control levee and Smoky Hill River commonly known as the Riverwoods Natural Area to allow the City of Salina to extend emergency services and law enforcement jurisdiction over this public recreation area.
