AN ORDINANCE LEVYING A TRANSIENT GUEST TAX UPON THE GROSS RECEIPTS DERIVED FROM OR PAID DIRECTLY OR THROUGH AN ACCOMMODATIONS BROKER BY TRANSIENT GUESTS FOR SLEEPING ACCOMMODATIONS WITHIN THE CITY OF SALINA FOR THE PROMOTION OF TOURISM AND CONVENTIONS; AND REPEALING RESOLUTION NUMBER 14-7151.

 

WHEREAS, Charter Ordinance Number 35, as it provided substitute provisions for K.S.A 12-1697, authorized the Board of City Commissioners of the City of Salina to levy a transient guest tax at not to exceed the rate of 6.75%; and

 

WHEREAS, Resolution Number 09-6647, adopted August 10, 2009, levied a transient guest tax which increased from 5% to 6.7% effective October 1, 2009 for a period of 10 years and was to reduce from 6.7% to 5.7% effective October 1, 2019; and

 

WHEREAS, Resolution Number 14-1751, adopted November 10, 2014, confirmed the transient guest tax levy of 6.7% and provided for the continuation of the transient guest tax levy at that same rate until modified by the governing body of the City of Salina, Kansas; and

 

WHEREAS, Charter Ordinance Number 40 enacted May 24, 2021 and effective August 5, 2021, as it provides substitute provisions for K.S.A. 12-1697, authorized the Board of City Commissioners of the City of Salina to levy a transient guest tax at not to exceed the rate of 7.75% and repealed Charter Ordinance Number 35; and

 

WHEREAS, the Governing Body desires to increase the transient guest tax rate from 6.7% to 7.75%; SO NOW, THEREFORE,

 

BE IT ORDAINED by the Governing Body of Salina, Kansas:

 

Section 1.  Transient Guest Tax Levy. There is levied pursuant to Charter Ordinance Number 40 a transient guest tax upon the gross receipts derived from or paid directly or through an accommodations broker by transient guests for sleeping accommodations, exclusive of charges for incidental services or facilities, in any hotel, motel, or tourist court located within the corporate limits of the City of Salina, Kansas at the rate of 7.75% effective October 1, 2021, and continuing until modified by the governing body of the City of Salina, Kansas.

 

Section 2.  Collection and Administration. The transient guest tax levied under Section 1 shall be collected and administered in accordance with the provisions of Charter Ordinance Number 40 and applicable Kansas law, and shall be used to promote tourism and convention as authorized by the governing body of the City of Salina.

 

Section 3. Repealer. Resolution No. 14-7151 is repealed effective October 1, 2021.

 

Section 4.  Effective.  This ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper by the following summary:
