ORDINANCE NUMBER 14-10728

 

AN ORDINANCE AMENDING CHAPTER 2, ARTICLE XII, OF THE SALINA CODE BY AMENDING SECTION 2-235 PERTAINING TO PROCEDURES IN CONTRACTING FOR SERVICES RELATED TO PUBLIC IMPROVEMENTS.

 

            BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:

 

            Section 1.  Amendment.  That Section 2-235 of the Salina Code be amended as follows:

 

Sec. 2-235. Process for new construction, addition or substantial alteration.

 

(a)    Alteration of a public improvement to satisfy requirements governing accessibility for persons with disabilities shall be accomplished by use of competitive practices.

 

(b)   In the case of new construction, an addition, or other substantial alteration to a public improvement with an estimated cost of ten thousand dollars ($10,000.00) or less, the city shall utilize competitive practices in the awarding of a contract.

 

(c)    In the case of new construction, an addition, or other substantial alteration to a public improvement with an estimated cost in excess of ten thousand dollars ($10,000.00), the city shall utilize a sealed bid process in the awarding of a contract, except as otherwise authorized by the governing body upon a finding that an alternative process is in the public interest. If all bids exceed the engineer's estimate, the city manager shall provide a report to the governing body citing reasons why the bids exceed the engineer's estimate. The governing body may award the contract notwithstanding the fact it exceeds the engineer's estimate based upon a finding that such an award is in the public interest and that adequate funds are available to complete the project.

 

          Section 2.  Repealer.   That existing Section 2-235 of the Salina Code is hereby repealed.

On January 13, 2014, the City of Salina, Kansas, passed Ordinance No. 14-10728. The ordinance amends Chapter 2 of the Salina Code by amending Section 2-235 pertaining to procedures in contracting for services related to public improvements.
